Introduction

The following Terms of Use (hereafter referred to as the “Agreement”) apply to all legal relationships and liabilities arising from the use of Sendcrux and WarmupIP (products of Info Science Labs) by any individual or entity (“you”) that creates access to our services for personal or business use. If an individual is using Sendcrux or WarmupIP on behalf of an organization, then this Agreement is entered into by that organization.

Hereafter, all references to “you” include such individuals or organizations responsible for creating and managing access accounts for Sendcrux and/or WarmupIP.

This Agreement permits any individual or organization to access Sendcrux and WarmupIP (collectively, the “Services”) and use them for business and other permitted purposes, on the condition that they agree to the Terms of Use set out on this page. These terms apply to any interaction the user has with the Services in any form. They also define how the Services will be delivered and the extent of Info Science Labs’ legal liability.

This Agreement governs the use of the Services from the Effective Date onwards. The Effective Date is the date one day prior to your first use of our Services by means of any online interaction. As used in this Agreement, “Sendcrux” and “WarmupIP” refer to products and services provided by their holding company, Info Science Labs.

From time to time, these terms may be updated. Users are required to visit this page periodically to ensure ongoing compliance with the latest version. Users of the Services will be notified when material changes to the terms are made. By continuing to use our Services, you confirm that you accept the terms and conditions mentioned on this page and agree to be legally bound by them. You agree that this document and its terms are legally binding for all interactions and disputes, and that this document will serve as the legal framework to resolve such issues going forward.

Legal Notice

1. These Standard Contract Terms and Conditions (hereafter “SCTC”) define the access conditions and Terms of Use of Sendcrux and WarmupIP services.
2. By becoming a user, or by clicking the “I accept the terms and conditions” checkbox, you acknowledge that you have read and understood the Terms of Use and agree to be legally bound by them.
3. The SCTC and any modifications are posted on this website. Users are expected to stay informed about updates and continue using the Services only if they agree with the updated terms.
4. These terms govern your use of the websites, including but not limited to https://sendcrux.com, https://warmupip.com, and any related subdomains and services, along with any information or material provided by Info Science Labs through these channels.
5. By using our Services, you acknowledge that your electronic submissions constitute a contract between you and Info Science Labs (for Sendcrux and WarmupIP). This contract applies to all transactions and records you enter on our websites, including notices about cancellation of services, new policies, contracts, and applications. In order to use our Services, you may require certain hardware, software, or internet connectivity. Procuring and maintaining such requirements is your sole responsibility.
6. Info Science Labs does not assume liability for typographical errors in the Terms of Use, product descriptions, or accompanying materials.
7. Sendcrux and WarmupIP together provide email infrastructure, warmup, deliverability, and email marketing platforms, along with data, analytics, and integrations that help users expand the reach of their products or services. Any new features added to the above service categories are also subject to these Terms of Use.

Your Account With Us

1. One person is allowed to create only one account per service unless explicitly permitted otherwise.
2. The data you provide to Sendcrux or WarmupIP is your sole responsibility, and you agree to keep such information accurate, complete, and up to date.
3. You acknowledge that the email address you provide during account creation will be used as the primary channel of communication between Info Science Labs and you.
4. Info Science Labs cannot fully verify the identity of every user that registers on the platform. You are responsible for maintaining the confidentiality and security of your account credentials. If you believe your account has been compromised, you must notify us immediately.
5. Your password is strictly confidential and must not be shared with any third party. Info Science Labs cannot be held liable for theft or loss of passwords.
6. You are responsible for any activity carried out through your account and agree not to attempt any attacks on our servers or infrastructure, including but not limited to viruses, worms, or other malicious code.
7. These terms grant you only a limited, non-exclusive right to use our online emailing, warmup, and marketing systems. You are not granted any license to the underlying software. You must not reverse engineer, decompile, attempt to obtain source code, or modify our software for commercial benefit. You must not share access to the Services or related software with any third party without our written consent, nor remove any labels, trademarks, or proprietary notices.

What We Understand as Our Duty

1. Info Science Labs grants users a non-exclusive right to use Sendcrux and WarmupIP and related services, subject to payment of applicable fees and compliance with these SCTC.
2. All products and services are provided on an “as-is” and “as-available” basis, without warranties of any kind, unless explicitly stated otherwise.
3. Info Science Labs will make reasonable efforts to inform users if a significant issue in the application or internal servers may affect performance, and will keep users updated on remediation efforts.
4. Info Science Labs shall not be liable for any loss or damages arising from your use of the Services, including performance issues, downtime, or third-party contractual relationships. We are not responsible for obligations between you and your clients, customers, or other third parties.
5. Info Science Labs reserves the right to access user accounts when required for maintenance, troubleshooting, security, compliance checks, or support purposes.

What We Expect From You

1. This section defines the rights and obligations of users and the structure of their contractual relationship with Info Science Labs as provider of Sendcrux and WarmupIP.
2. Info Science Labs is entitled to keep users informed of changes in informational and contractual terms. In case of failure to adhere to technical or security standards, Info Science Labs reserves the right to suspend or limit services until appropriate maintenance or corrective action is completed.
3. You agree that you are aware of the rules and regulations governing the sending of electronic communications (email and related channels). Info Science Labs will not be responsible for any unlawful, abusive, or ill-structured traffic generated by users.
4. You grant Info Science Labs the right to use your name, trademarks, and logos to identify you as a customer of Sendcrux or WarmupIP, including on our websites, marketing materials, presentations, newsletters, or social media, unless otherwise agreed in writing.
5. You agree to provide all information reasonably required for Info Science Labs to operate and support the Services for your account, including technical contacts, billing details, and compliance information.
6. You agree to pay the applicable fees for campaigns, warmup services, and related features as per the pricing and contract agreed upon with Info Science Labs. Non-payment may result in suspension or termination of services.
7. You are not permitted to sublicense, resell, or otherwise commercialize access to Sendcrux or WarmupIP to third parties, unless covered under a specific written reseller or partner agreement with Info Science Labs.

Anti-Spam Policy & Acceptable Use

To protect inboxes, maintain the reputation of our IPs and domains, and safeguard the wider email ecosystem, Sendcrux and WarmupIP enforce a strict Anti-Spam and Acceptable Use Policy. By using our Services, you agree to thes following:

• 1. No unsolicited email (no spam):
• You must only send email to recipients who have explicitly opted in or who have a clear, provable business relationship with you (e.g., existing customers, active users).
• You are not allowed to send to purchased, rented, scraped, or third-party lists, even if those lists are described as “opt-in”.

• 2. Consent & transparency:
• All subscription forms, landing pages, and lead collection methods used with our Services must clearly state the type of emails the recipient will receive.
• Every commercial or marketing email must:
  • Clearly identify the sender and brand
  • State why the recipient is receiving the message
  • Include a valid physical mailing address

• 3. Unsubscribe and preferences:
• All non-transactional messages must include a clear, visible, and functioning unsubscribe link that can be used without logging in.
• Unsubscribe requests must be honored promptly, within the time frame required by applicable laws.
• You must not re-add unsubscribed recipients unless they explicitly opt in again.

• 4. Content restrictions:

You may not use the Services to send content that is illegal, abusive, harmful, or that violates the rights of others, including but not limited to:
• Fraudulent, deceptive, or misleading content;
• Phishing or attempts to obtain sensitive information unlawfully;
• Content that promotes violence, hate, or discrimination;
• Malware, viruses, or links to malicious websites;
• Content prohibited by applicable laws and regulations in the sender’s or recipient’s jurisdiction.

• 5. Deliverability & complaint control:
• You must actively monitor your bounce rates, complaint rates, and engagement metrics and keep them within accepted industry and ISP norms.
• You must promptly remove or suppress email addresses that result in hard bounces , repeated soft bounces, or spam complaints.
• If we identify unusually high bounce or complaint rates, or patterns associated with spam, Info Science Labs may throttle, suspend, or terminate your use of the Services to protect our infrastructure and other users.

• 6. Abuse monitoring and enforcement:
• Info Science Labs may monitor traffic patterns, headers, and other metadata (not message content unless necessary) to detect abusive or non-compliant sending.
• We reserve the right to suspend or terminate accounts, IPs, or sending domains, with or without prior notice, if we believe they are being used in violation of this Anti-Spam Policy or any applicable law.
• In serious or repeated violations, we may cooperate with ISPs, anti-spam organizations, or law enforcement authorities as required.

By using Sendcrux and WarmupIP, you acknowledge that violating this Anti-Spam and Acceptable Use Policy may result in immediate suspension or termination of your access to the Services, without refund.

Payment

1. To use Sendcrux and WarmupIP, you agree to pay Info Science Labs the applicable fees. By agreeing to these terms and paying the fee, you become a User of the Services. All conditions mentioned on this page apply to you as a User, along with any website visitors who submit forms or otherwise interact with our systems.
2. Info Science Labs reserves the right to modify its pricing and related terms. Any changes will be communicated to users in advance, in accordance with the applicable agreement.
3. For credit card or online payments, you are responsible for ensuring that your payment method is valid and has sufficient funds or limits.
4. Electronic invoices will be generated for users who have opted for our services and will be sent via email within a reasonable time after payment.
5. If you terminate your account or service plan, Info Science Labs is not obligated to refund any fees already paid, unless explicitly stated in a separate contract or required by law.

Intellectual Property

The Sendcrux and WarmupIP websites, services, content, software, graphics, databases, and related materials are the exclusive property of Info Science Labs and/or its licensors. Any reproduction, distribution, or commercial exploitation without our explicit written consent is strictly prohibited.

You are strictly forbidden from attempting to access our source code, bypass security controls, or install malware that could partially or completely disrupt our Services. Info Science Labs reserves all Intellectual Property rights in its Services. Any attempt to reverse engineer, clone, or re-sell them in violation of these terms may result in legal action.

Damages

Except for excluded claims described in these terms, Info Science Labs (including with respect to Sendcrux and WarmupIP) shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of data, loss of profits, or business interruption, even if we have been advised of the possibility of such damages.

If Info Science Labs is found liable to you for any damages arising under this Agreement, such liability will be limited to the amount you paid to Info Science Labs for the Services during the twelve (12) months preceding the date on which liability arose. “Excluded claims” refer to claims arising from your breach of your general obligations under this Agreement or any willful misconduct.

Settlement of Disputes

1. Info Science Labs will make reasonable efforts to resolve any disputes with users through good-faith negotiation before resorting to formal legal proceedings. Both parties agree to cooperate and keep each other informed of all relevant developments without undue delay.
2. The laws of the country of incorporation of Info Science Labs will govern the validity and interpretation of these terms and any disputes arising out of or relating to this Agreement. You agree to submit to the jurisdiction of the appropriate courts in such location, unless otherwise required by mandatory law.
